In this case, the petitioner is seeking bail in connection with Pupari P.S. Case No. 257 of 2015 for offence under Section 304(B)/34 of the Indian Penal Code.
The petitioner is a husband. The victim lady has died on account of burn injury. Allegation has been made of demand of dowry.
Learned counsel for the petitioner submits that F.I.R. has been lodged after a long gap of date of occurrence. The victim had come two days earlier. It is a case of accident. Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner,
Patna High Court Cr.Misc. No.17064 of 2016 (2) dt.25-04-2016 namely, Md. Mustaque @ Guddu is rejected.
The trial court is directed to conclude the trial of the petitioner within a period of one year from the date of receipt/production of a copy of this order and if the trial would not be completed with the aforesaid period of one year, the petitioner will be at liberty to renew his prayer for bail.
