JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-03-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offence punishable under section 302 of the I.P.C Allegedly, the petitioner having two wives killed his first wife Parbati Devi after assaulting and hanging her in ceiling fan.

Submission is of false implication and that no injury has been found on the person of the deceased, as a matter of fact the petitioner has performed second marriage with the sister of his first wife with the consent of his first wife, due to some dispute the first wife of the petitioner committed suicide by hanging herself, no injury has been found on the person of the deceased and as

No.24923 of 2015 (6) dt.15-03-2016 2/2 such the petitioner deserves sympathetic consideration, to which the learned A.P.P. opposes by submitting that the daughter, son and mother of the petitioner during investigation have stated that the petitioner killed his first wife by hanging her. In the facts and circumstances as stated above, considering the allegation attributed against the petitioner, serious in nature, this Court is not inclined to enlarge the petitioner on bail and accordingly his such prayer stands rejected in connection with Sessions Trial No. 197 of 2015 arising out of Dhanarua P.S. Case No. 357 of 2014/ G.R. No. 1122 of 2014 pending in the court of the Additional District & Sessions Judge- Vth, Patna. However, considering detention of the petitioner let the trial be expedited.
