ANJANA MISHRA ORAL ORDER 25-05-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are in custody since 31.10.2014 in connection with Magadh Vishvidyalaya P.S. Case No. 64 of 2014 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Learned counsel for the petitioners submit that though there is specific allegation of assault by three persons, the postmortem report does not clearly reveal that there is attack by all persons as only one abrasion has been found on the person of the deceased. It is further submitted that there is history of land dispute between the parties and, therefore, the petitioners have been falsely implicated in this case.
Patna High Court Cr.Misc. No.10962 of 2015 (3) dt.25-05-2015 Considering the aforesaid submission and also the fact that the petitioners have since been in custody 31.10.2014 and have no criminal antecedent, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Gaya in connection with Magadh Vishvidyalaya P.S.
