The petitioner is in custody in connection with Deo P.S. Case No. 147 of 2021 registered for an offence punishable under Sections 147, 149, 323, 325, 307, 379, 504 and 506 of the Indian Penal Code.

As per prosecution case, it is a case of assault of informant and other co-villagers of the informant by seven named accused persons due to enmity. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. He next submits that both parties received injuries and no specific allegation has been levelled as against this petitioner. Petitioner has got

However, learned APP for the State opposes the prayer for regular bail of the petitioner.

On perusal of the first information report, injury report as well as impugned order, it appears that all the injuries has been sustained only once and no repeated injury is caused to the informant and the co-villagers of the informant and a compromise petition has already been filed before the trial Court, considering which, I am inclined to grant bail to the petitioner. Accordingly, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Aurangabad in connection with Deo P.S. Case No. 147 of 2021.
