JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

Petitioner happens to be mother in law of the deceased and the learned Sessions Judge has referred para-19 of the case diary to show the involvement of the petitioner in the alleged crime. At para-19 of the case diary, the statement of daughter of deceased was recorded and the daughter of deceased who was seven years old at the time of alleged occurrence specifically stated that it was her aunt who set fire on the deceased. Almost similar statement has been made by son of the deceased.

Considering the aforesaid facts and circumstances as

No.25580 of 2015 (4) dt.14-10-2015 2/2 well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 27.03.2015, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Surajgarha P.S. Case No. 56 of 2015.
