JUSTICE AJIT KUMAR ORAL ORDER 22-08-2025 Yesterday, when this case was taken up, no one had appeared on behalf of the petitioner, and today also, when this matter was called, no one appeared. Learned counsel for the State and learned counsel for the University are present.
2. The petitioner has filed this writ petition for the following reliefs :- "i. For grant of pension of the petitioner who has joined in service in J.P. College, Narayanpur, Bhagalpur under Tilka Manjhi University, Bhagalpur on 15.12.88 as Lab. Incharge and retired on 28.02.2010 but till date his

ii. For payment of arrear amount of pension of the petitioner which is lying before the University since ten years with interest and cost. iii. To grant other relief/reliefs as the petitioner is entitled in the facts and circumstances of the case."

This case is of the year 2021, and the counter affidavit has very recently been filed by respondent Nos. 3, 4, and 6, wherein the relief sought by the petitioner is said to have been redressed by the University by constituting a Three-Men Committee vide office Order No.144/2024 dated 29.10.2024, and it's report to the Vice-Chancellor of the University with recommendations that has been sent for consideration. The specific stand which has been taken in the counter affidavit filed on 02.07.2025 and the averments to this effect is indicated in paragraph 7 of the counter affidavit, which is reproduced hereunder: - "That it is further stated and submitted that in compliance of the order dated 21.02.2023 passed in LPA No.728 of 2014, the Vice Chancellor of the answering University constituted a Three Men Committee vide Office Order No.144/2024 dated 29.10.2024. The Three Men Committee submitted its report to the Vice Chancellor of the University on 08.12.,2024 with a recommendation
Patna High Court CWJC No.5008 of 2021(14) dt.22-08-2025 3/3 that since Sri Rajendra Poddar (Petitioner herein) has filed a separate case i.e. CWJC No.5008 of 2021 before this Hon'ble Court, therefore, decision with respect to his Absorption may be kept in abeyance till the disposal of aforesaid case.
4. The document to this effect, the Officer Order No.144/2024, based on which such submissions is said to have been made, is appended as Annexure-A to the said counter affidavit. Be that as it may, this matter is disposed of with a direction that the University would be obliged to take a decision on the claim of the petitioner, but before doing so, the competent authority (respondent No.4) would be obliged to issue notice to the petitioner so that proper hearing could be given to the petitioner and he may not have any grievance of not being heard before any final decision is notified.
5. In view of such a matter, this matter is directed to be disposed off with a direction that the entire exercise shall be completed within a period of six weeks from today. (Ajit Kumar, J) sharun/- U
