ANJANA MISHRA ORAL ORDER 25-05-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is in custody since 29.12.2014 in connection with Maheshkunt P.S. Case No. 129 of 2014 for the offences punishable under Sections 406, 409, 420, 469, 468, 471/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has been named in the present First Information Report though he had been removed from the post of the Branch In-charge of Maheshkunt branch on 25.04.2012 itself. Learned counsel for the petitioner submits that after he left office another person, namely, Surya Narain Chourasia took over the charge as the petitioner has nothing to do with the present act of non-return of money of the depositors. It has also come on record that in the month of July,
Patna High Court Cr.Misc. No.11110 of 2015 (4) dt.25-05-2015 P2/2 2013, the said company was closed but the petitioner having been removed much earlier cannot be implicated in any sort of case as he was no where associated with the said company. . Considering the aforesaid submissions and the period of custody and also the fact that the petitioner has no criminal antecedent, let the petitioner Arun Chaurasia be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Maheshkunt P.S. Case No. 129 of 2014.
