ANJANA MISHRA ORAL ORDER 25-05-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody on his remand since 20.09.2014. Learned counsel for the petitioner submits that while the petitioner was in custody in connection with Danapur P.S. Case No. 213 of 2014 registered for offence punishable under Sections 302, 120B of the Indian Penal Code and 27 of the Arms Act, the petitioner was remanded in connection with the present case. Learned counsel for the petitioner further submits that as per the First Information Report, it was one Sanjay Singh who had been putting pressure on the informant's mother-in-law for selling of a piece of land which she had been strongly refusing and because of that reason with the assistance of the other killed the

Patna High Court Cr.Misc. No.11115 of 2015 (3) dt.25-05-2015 P2/2 mother-in-law. Learned counsel for the petitioner further submits that on remand the petitioner himself confessed the guilt in front of the Police which has no evidentiary value. Considering the fact that the petitioner has been in custody since 20.09.2014 and there is no specific material to connect the petitioner with the present offence save and except his own statement, let the petitioner Raja @ Raj Kumar, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Danapur P.S.
