The petitioner seeks bail in a criminal prosecution registered under Sections 304-B and 201/34 of the Indian Penal Code.
Taking into consideration the fact that the petitioner happens to be the husband of the deceased and death of the deceased had taken place within two years of marriage and further taking into consideration that the case of the petitioner has been committed to the court of session giving rise to Sessions Trial No. 63 of 2015, this Court is not inclined to accede to the prayer for grant of bail at this stage. Accordingly, the prayer for bail of the petitioner in connection with Sessions Trial No. 63 of 2015 arising out of Bhagwanpur P.S.Case No. 112 of 2014 pending in the court of 3rd Additional Sessions Judge, Vaishali at Hajipur is rejected. The trial court is directed to frame charge against the petitioner, if not already framed and after framing of charge, all endeavour shall be made to conclude the trial at an early date preferably within a period of one year and if the trial is not
