The petitioner is languishing in custody since 28.10.2018 in a case registered for the offence punishable under Section 366(A) of the Indian Penal Code.

The prosecution case as per the written report of Manju Devi submitted to SHO, Gopalganj is to the effect that on 12.03.2018 at 9.00 A.M., while the informant's minor daughter Puja Kumari was going to school then five accused persons including the petitioner kidnapped the daughter of the informant on the pretext of her marriage with co-accused Sandeep Bharti. It is submitted by learned counsel for the petitioner that the thrust of accusation is against the co-accused Sandeep

Patna High Court Cr.Misc. No.2376 of 2019(2) dt.21-01-2019 2/2 Bharti. It is further submitted that the petitioner is employed at Gujrat and on the day of occurrence he was in Gujrat. It is further submitted that for the occurrence of 12.03.2018 the FIR was registered on 01.04.2018. A statement has been made in paragraph no. 3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP for the State submits that petitioner is named in the FIR.

Considering the delayed lodging of the FIR and the thrust of accusation against the co-accused Sandeep Bharti, coupled with statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Gopalganj Town P.S.
