The petitioner seeks bail in Karpi P.S. Case No. 164 of 2013 dated 14.10.2013 instituted under Sections 364/120B/34 of the Indian Penal Code to which lateron Sections 302/201 of the Indian Penal Code and 3(ii) of The Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 were added.
This is the second attempt of the petitioner for bail as earlier such prayer was rejected by order dated 04.09.2014 in Cr. Misc. No. 23514 of 2014 by which the Court below was directed to expedite the trial and conclude the same within nine months.
In view of the aforesaid, a report was called from the Court below by order dated 09.03.2016. The same has been received from the Learned Additional Sessions Judge, Ist, Jehanabad dated 14th March, 2016 in which it has been prayed
Patna High Court Cr.Misc. No.26920 of 2015 dt.20-04-2016 2/2 that this Court may grant further three months time for disposal of the case.
In view of such request from the Court below, the Court does not find it expedient to consider the prayer for bail of the petitioner. Accordingly, the same stands rejected. However, in terms of the request made by the trial Court itself, let the case be finally disposed off within three months and compliance report submitted to the Court.
