The petitioner seeks bail in anticipation of his arrest in connection with Vaishali P.S. Case No. 328 of 2020, dated 01.10.2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 427, 504, 506 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

Regard being had to the fact that the petitioner has

Patna High Court CR. MISC. No.14598 of 2021(3) dt.16-02-2022 2/2 been declared an absconder, notwithstanding the fact that it is with respect to a case which has been lodged by one of the relatives of the informant of the subject F.I.R., I am not inclined to grant him anticipatory bail.

The prayer for grant of anticipatory bail to the petitioner is, accordingly, rejected.

However, if he surrenders before the Court below and seeks bail, the Court below shall consider the case on its own merits, without being prejudiced by the fact that the present anticipatory bail application on his behalf has not been entertained by this Court.

The application stands dismissed.
