The present writ petition has been filed for:- (A) To issue a writ in the nature of certiorari setting aside the provisional land settlement certificate vide Memo No. Nil, Case No. nil dated 30.1.1993 issued by Circle Officer, Supaul-cum-Collector under the Act allotting 1 decimal of land in favour of petitioner (Muneshwar Mandal) and 5 decimal of land in favour of Late Nageshwari Devi, mother of Pradeep Mandal (Respondent No.7) (Annexure-'3 Series) appertaining to Khata No. 482, Khesra No.1214, Mauza-Kareho, Thana No.219, Circle + District-Supaul.

B) To issue a writ in nature of

Patna High Court CWJC No.9846 of 2017(2) dt.21-04-2025 2/2 certiorari setting aside order dated 29.4.2017 passed in Misc. Case No. 99/2014 by Additional Collector, Supaul upholding the issuance of provisional land settlement certificate (Annexure8). C) And/or any other relief or reliefs for which the petitioner is found entitled to in the facts and circumstances of this case."

A counter affidavit has come on behalf of respondents no.4 to 6 and learned State counsel has taken this Court to paragraph-6 to show that the petitioner has also filed Title Suit before the competent Civil Court. The said counter affidavit has been filed in the year 2023 and there is no rejoinder or the refutal to it.

4. Learned counsel for the petitioner, in that background, submits that he shall be pursuing the said legal remedy available to him in accordance with law.

5. Granting said liberty, the writ petition stands disposed of.
