The petitioner seeks bail in a case instituted for the offences under Sections 379 and 420 of the Indian Penal Code.

Allegation has been made that the petitioner by manipulation and changing the ATM Card has withdrawn heavy amount. As per claim of the petitioner, he was arrested in connection with Kanti P.S. Case No.524 of 2015 with identical allegation in which he was granted bail and after release he was remanded in the present case. Petitioner is a student of B.A. Part II and he is in jail since 25.1.2016. Having considered the facts and circumstances of the

No.18411 of 2016 (4) dt.13-07-2016 case, let petitioner, Vikash Kumar, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, in connection with Bettiah (Town) P.S. Case No.816 of 2015, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioner i.e father, mother and brother (ii) If the petitioner is found involved in future in similar type of case the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order including cancellation of bail and (iii) petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner.
