JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named but in course of investigation, the name of petitioner surfaced in this case on the basis of information, of spy of the police and subsequently, the house of the petitioner was searched and fire-arms and mobiles are said to have been recovered.

Learned Additional Public Prosecutor, appearing for the State fairly conceded this fact that learned trial court has committed error in observing that looted motorcycle had been recovered from possession of the petitioner on the basis of his confessional statement.

Considering the above-said facts and circumstances of

Patna High Court Cr.Misc. No.28087 of 2015 (4) dt.29-10-2015 2/2 the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Andhratharhi P.S. Case No. 11 of 2014 corresponding to Sessions Trial No. 396 of 2014 to the satisfaction of learned Additional Sessions Judge-IV, Madhubani. (Hemant Kumar Srivastava, J) A.K.V./- U T
