JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioner is languishing in custody since 05.04.2014 in connection with Mednichowki P.S. Case No. 25 of 2015 for the offences instituted under Sections 147, 148, 149, 324, 307, 387, 506 of the I.P.C., 27 of the Arms Act and 3(1)(x) of the SC/ST (Prevention of Atrocities) Act.
Heard learned counsel for the petitioner and learned counsel for the State and the informant.
The accusations are of abusing the informant and demanding Rs. 5,00,000/- as ransom from the informant. The accused persons also fired at the informant as a result of which he sustained fire arm injury. On chasing by the villagers, the accused persons fled away.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.25420 of 2015 (2) dt.21-07-2015 2/2 petitioner is in custody since 05.04.2014 and the charge sheet has been submitted in the present case. It is further submitted that the omnibus and general allegation has been made against the petitioner. No specific injury has been attributed against the petitioner.
On behalf of the State and the informant it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Lakhisarai, in connection with Mednichowki P.S. Case No. 25 of 2015. U.K./- (Sudhir Singh, J) U T
