1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Beldaur P.S. Case no.130 of 2023 registered under sections 304B and 34 of the Indian Penal Code to which section 498A of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act were added subsequently.

3. As per the prosecution case, the informant states that the accused persons including the petitioner herein who happens to be the devar of his daughter tortured his daughter for non-fulfillment of demand of dowry which was by way of a motorcycle and Rs.2 lacs in cash and she was ultimately done to death.

4. Learned counsel for the petitioner submits that the

The informant is not an eye witness to the occurrence. The husband of the deceased is in custody and the petitioner is in custody since 12.8.2023. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the petitioner being the devar of the deceased, grant of bail to the other co-accused vide order dated 5.12.2023 passed in Cr. Misc. no.73700 of 2023 and the petitioner having remained in custody for 6 months since 12.8.2023, the Court directs the petitioner to be enlarged on bail in connection with Beldaur P.S. Case no.130 of 2023 (G.R. no.1936 of 2023) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class-cum-A.M., Khagaria.
