JUSTICE SUDHIR SINGH ORAL ORDER 20-07-2015 The petitioner is languishing in custody since 28.11.2014 in connection with Karja P.S. Case No. 61 of 2014 for the offences instituted under Section 376 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.

It is alleged that the petitioner established forceful physical relationship with the informant's daughter. It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.11.2014 and the charge sheet has been submitted in the present case. It is further submitted that the petitioner has falsely been implicated in the present case for the reason that the occurrence is said to have taken place on 21.03.2014 as to when the present case has been instituted on

Patna High Court Cr.Misc. No.25029 of 2015 (2) dt.20-07-2015 2/2 23.04.2014 and for the said delay no explanation has been made on the part of the prosecution.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R. and there is direct allegation against him.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO at Muzaffarpur, in connection with Trial No. 12 of 2015, arising out of Karja P.S.
