Petitioner happens to be husband of the complainant and is languishing in jail custody since 27.04.2015 in a complaint case in which cognizance has been taken for the offences punishable under Section 498 A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.
The solemn affirmation of the complainant recorded in course of enquiry reflects that it was father in law of the complainant who made illegal demand and attempted to establish

No.25863 of 2015 (2) dt.24-07-2015 physical relationship with her and so far as petitioner is concerned, there is no specific allegation of illegal demand as well as torturing against him and apart from this, the complainant specifically stated in her solemn affirmation that she will go along with petitioner, if petitioner makes provision for a separate residence from his other family members.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Kishanganj in connection with Complaint Case No. 1418 C of 2013.
