This application, for grant of anticipatory bail, arises out of Kotwali (Adampur) Police Station Case No. 662 of 2016, disclosing offences under Sections 409, 420, 467, 468, 471 and 120B of the Indian Penal Code.

It is alleged in the First Information Report that for securing appointment as Panchayat Teacher, the petitioner furnished certain documents in relation to the educational qualification which have been subsequently found to be forged and fabricated.

Learned Counsel for the petitioner has submitted that since the allegation levelled against the petitioner is based on

Patna High Court Cr.Misc. No.5129 of 2019(2) dt.30-01-2019 2/2 documents, there is no chance of tampering with the evidence and there is no question of the petitioner fleeing from the course of investigation or trial.

Let the petitioner, Priya Kumari, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Adampur) Police Station Case No. 662 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bond shall be liable to be cancelled.
