JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 Petitioner seeks bail in connection with Sessions Trial No. 680 of 2019, arising out of Bagaha (Pathkhauli) P.S. Case No. 217 of 2019, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 379, 307, 302 and 506 of the Indian Penal Code.

As per prosecution case, petitioner and two other accused persons caught hold of the deceased and one Bhola Pahalwan stabbed the deceased.

Submission of learned counsel for the petitioner is that one Bittu Yadav, against whom there is allegation of catching hold of the deceased, has been granted bail by a coordinate Bench of this Court by order dated 27.11.2019 passed in Cr.Misc.No. 61842 of 2019 and petitioner is in custody for

Patna High Court CR. MISC. No.5385 of 2020(2) dt.31-01-2020 2/2 almost nine months.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I, Bagaha, West Champaran, Bettiah, in connection with Sessions Trial No. 680 of 2019, arising out of Bagaha (Pathkhauli) P.S.
