Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Amas P.S. Case No. 242 of 2021 instituted for the offences under Sections 414/34 of the Indian Penal Code read with Section 37(2) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
Learned counsel for the petitioner submits that the petitioner is in custody since 04.09.2021, is a person with clean antecedent and charge-sheet has been submitted. The allegation against the petitioner is that he was found in a drunken state while he was driving the motorcycle. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.4905 of 2022(2) dt.08-03-2022 2/2 petitioner has been falsely implicated in the present case and the petitioner was not in a drunken state. Since the petitioner did not grease the palm of the police, he was implicated falsely in the present case.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted, let the petitioner above named be released on bail on furnishing bail bond of Rs.500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Gaya in connection with Amas P.S.
