The petitioner seeks bail in Ara Muffasil P.S. Case No. 183 of 2020, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, on the alleged date of occurrence, father of informant went on motorcycle to the clinic of the petitioner with Rs. One lakh for purchasing a piece of land. When he did not return, informant went at the clinic of petitioner, but he did not find his father. On next day in the morning, informant learnt that dead-body of his father is lying near Kaushik Dularpur. Informant suspects that petitioner with the help of others committed murder of his father for grabbing

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. Name of this petitioner has surfaced in this case on the basis of confessional statement of co-accused Pintu @ Pitoo @ Amzad Ali who has already been granted bail by this Court vide order dated 23.03.2021 passed in Cr. Misc. No. 4412 of 2021. Save and except confession of coaccused there is no material which show involvement of this petitioner in the alleged occurrence. Petitioner is in custody since 03.11.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VII, Bhojpur at Ara in connection with Ara Muffasil P.S.
