Petitioner seeks bail in a case registered under section 395 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, some witnesses claimed to have seen the petitioner and others roaming near the place of occurrence before the alleged occurrence and after that some co- accused were arrested and made confessional statement. It appears that except the aforesaid material, there is nothing against the petitioner. Moreover, petitioner is in jail custody since 10.2.2016 but the I.O did not make arrangement for test identification parade of the petitioner.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial
