Petitioner is languishing in custody since 12.12.2014 in a case registered for the offences punishable under Sections 363, 364, 201 of the Indian Penal Code. It is alleged that the husband of the informant went to Ludhiyana in company of petitioner on 05.02.2008, thereafter he did not return. Though, in the meantime, some money was given to the informant by the accused persons.
It is submitted by the learned counsel for the petitioner that during investigation, it was found that in the revenue records it was recorded that the husband of the informant died before 2002. The said fact has been recorded in paragraph-49 of the case diary. Statement has been made in
Patna High Court Cr.Misc. No.13010 of 2015 (4) dt.30-06-2015 para-3 of the petition that petitioner has no criminal antecedent.
The contention of the learned counsel for the petitioner has not been controverted by the learned counsel for the State after going through the case diary. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Gopalganj in connection with Bijaipur P.S. Case No. 95 of 2014.
