Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Piro PS case no. 44 of 2024 dated 06.02.2024, disclosing offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

The prosecution story, as per the First Information report, is that on 06.02.2024, upon secret information that one person was carrying illicit liquor on a motorcycle, police party reached at Piro railway station. Upon seeing police party, the said person succeeded in fleeing away after leaving the motorcycle. On search, 30 liters of countrymade liquor has been recovered from the said

Learned Counsel for the petitioner submits that petitioner has been implicated in this case on account of the fact that he is the registered owner of the motorcycle. He further submits that the motorcycle was borrowed by a covillager and the petitioner was completely unaware that the same was being used for illegal purpose. He also submits that the liquor has not been recovered from the conscious possession of the petitioner and/ or premises belonging to him.

Having regard to the submissions made on behalf of the parties and taking into consideration the justification given by the petitioner regarding motorcycle being borrowed by some other person, I am inclined to grant the privilege of anticipatory bail to the petitioner.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned court of Exclusive Special Excise Judge, Excise Court No. II, Bhojpur, Ara in connection with Piro PS
