2. The petitioner is apprehending arrest in connection with Aayar P.S. Case No. 100 of 2023 instituted under Sections 341, 323, 307, 504, 379, 34 of the Indian Penal Code lodged on 12.7.2023 by the informant, Sunil Kumar Singh.

3. As per the prosecution story, the informant alleged that his agnate, Manish Kumar Singh was abusing his wife. When he and his wife objected, infuriated, Manish Kumar Singh assaulted him by iron rod on his head causing injury. When his wife came to rescue, one Bharat Singh assaulted her. They went to hospital and the FIR.

4. Learned counsel for the petitioner submits that the injury has been found to be simple in nature.

5. Learned APP, Mr. Jitendra Kumar Singh submits

Patna High Court CR. MISC. No.7753 of 2024(2) dt.17-02-2024 2/2 that the allegation of assault on the head is there and in that background, he should seek bail.

6. Taking into account the submissions put forward by the parties, this Court is of the opinion that it would be appropriate for the petitioner to seek bail.

7. So far as the anticipatory bail is concerned, the same is rejected.
