JUSTICE SHIVAJI PANDEY ORAL ORDER 18-06-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Buxar (T) P.S.Case No. 118 of 2015 registered u/s 147, 148, 149, 341, 386, 379, 337, 323, 436, 307, 332, 353, 427 of IPC. As per FIR large number of persons had resorted to vandalism, ransacked the Police Station, assaulted Police Personnel and badly damaged the Government property. Counsel for the petitioners submits that there is no specific allegation against the petitioner. He was one of the members of the mob. Co-accused Manoj Rai and others have been granted bail by this Court vide Cr. Misc.No. 17570 of 2015 and other analogous cases.

Looking to the nature of allegation, petitioner Raju Yadav is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.26061 of 2015 (2) dt.18-06-2015 2/2 amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar (T) P.S.Case No. 118 of 2015, subject to the conditions that:

(i) one of the bailors will be a close relative of the petitioners, (ii) if the petitioner would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including cancellation of bail bonds and (iii) the petitioner would co-operate and if the petitioner will fail to co-operate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court will pass appropriate order, including cancellation of bail bonds.
