JUSTICE ANIL KUMAR SINHA ORAL ORDER 21-08-2021 Heard Mr. Sheo Jee Mishra, learned counsel for the petitioner, Mr. Ranjay Kumar Singh, learned A.C. to S.C. -6 for the State and Mr. Sanjay Prakash Verma, learned counsel for the Patna Municipal Corporation through video conferencing. Learned counsel for the petitioner seeks permission to delete the name of respondent nos. 7, 8, 9 and 10. Permission is granted.

The name of respondent nos. 7, 8, 9 and 10 are deleted from the array of parties.

Petitioner has filed this writ application stating therein that in front of the house and landed property of the

Patna High Court CWJC No.5157 of 2021(2) dt.21-08-2021 2/3 petitioner bearing plot no. 2192, khata no. 1116 in Mauza -Digha, the respondent- Patna Municipal Corporation has constructed various urinals and toilets thus causing nuisance to the petitioner.

Learned counsel for the petitioner submits that a detailed representation in this regard has been filed before the Executive Officer, Patliputra Anchal at Annexure - 1 Series to the writ petition dated 21/12/2020, but the same is still pending. Learned counsel further submits that he will be filing a detailed representation before the Commissioner, Patna Municipal Corporation raising his grievance within a period of four weeks and the respondent no. 6 i.e. Commissioner, Patna Municipal Corporation may be directed to dispose of the representation of the petitioner in accordance with law. Learned counsel appearing for the P.M.C. has got no objection, if such order is passed.

Regard being had to the submissions made by the parties, the petitioner is permitted to file a detailed representation raising his grievance before the respondent no. -6 i.e. Commissioner, Patna Municipal Corporation within a period of four weeks and if such representation is filed, the respondent no. - 6 is directed to dispose of the same by a reasoned order in

Patna High Court CWJC No.5157 of 2021(2) dt.21-08-2021 3/3 accordance with law within a further period of three months. With the aforesaid observation and direction, this writ application is disposed of.
