The petitioner is in custody in a case registered under Sections 272 and 273 of the Indian Penal Code and Section 47(A) of Excise Act.

The prosecution case in, brief, is that while the informant along with his team was on patrolling duty, on receiving secret information he reached at Zero Mile Chowk and on seeing the police, the driver along with two others tried to flee away with Tempo but they caught. On search 192 liter of country made liquor has been found in the said tempo. It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.04.2015. It is further submitted

Patna High Court Cr.Misc. No.26002 of 2015 (2) dt.24-07-2015 2/2 that charge sheet has been submitted in this case. It is also submitted that the petitioner is the driver of the tempo in which country made liquor is said to have been recovered. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in Araria P.S.Case No. 145/2015.
