The petitioners apprehend their arrest in connection with Pakaridayal P.S. Case No.147 of 2016 registered under Sections 341, 342, 384/34 and 120(B) of the Indian Penal Code. The accusation is that the informant along with other police officials was on patrolling duty in the night of 21/22.2016. When he reached at Pakridayal Nehru Chowk, then found the four trucks in standing condition and saw that four persons were engaged in realizing the money from the trucks drivers. On seeing the police party, they started to flee away but
Patna High Court CR. MISC. No.9788 of 2019(3) dt.10-05-2019 2/2 Lal Babu Giri and Pundeo Mahto were apprehended. They disclosed the name of his associates as Shankar Paswan and Vishwanath Prasad, who succeeded to flee away. They also disclosed that they used to realize the money from the trucks drivers on the instruction of the petitioners. Learned counsel for the petitioners submits that the petitioners have no criminal antecedents and the name of the petitioners have come in the confessional statement of the apprehended co-accused Lal Babu Giri and Pundeo Mahto. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on thier furnishing bail bond of Rs.
10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Motihari, District-East Champaran, in connection with Pakridayal P.S. Case No.147 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S.
