The petitioner is in custody since 30.11.2014 in connection with Belsand P.S. Case No. 71 of 2013 for the offence registered under sections 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that only because there is some difference between the petitioner and the deceased regarding change of Maulwi of Madrasa, name of the petitioner has been included in the present case. It is further submitted that two other similarly situated persons, who are said to have been seen by the brother of the informant near the hut, have already been extended the privilege of anticipatory bail and regular bail. Learned counsel for the petitioner has brought on record the order dated 28.07.2014 passed in Cr. Misc. No. 20481

Patna High Court Cr.Misc. No.10953 of 2015 (3) dt.26-05-2015 of 2014 by which one Md. Sabir has been extended the privilege of anticipatory bail.

Considering the period of custody and also the fact that petitioner has no criminal antecedent, let the petitioner, as mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Belsand P.S. Case No. 71 of 2013.
