JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 Petitioner seeks bail in connection with Special (Excise) Case No. 590 of 2019, arising out of Nauhatta P.S. Case No. 114 of 2019, registered for the offences punishable under Sections 30(a), 38(1) and 41(1) of Bihar Prohibition and Excise Act.

Petitioner happens to be owner of the pickup van, from which there is recovery of 116 litres of liquor. Submission of learned counsel for the petitioner is that pickup van was handed over to the driver for the use of school and petitioner was not present there, having no criminal antecedent and he is in custody for almost two months. Heard learned APP also.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.5379 of 2020(2) dt.31-01-2020 2/2 Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Motish Kumar Singh, Special Judge, Excise Act, Saharsa, in connection with Special (Excise) Case No. 590 of 2019, arising out of Nauhatta P.S. Case No. 114 of 2019.
