ANJANA MISHRA ORAL ORDER 26-05-2015 Heard learned counsel for the petitioner, learned counsel for the informant and the learned counsel for the State. The petitioner is in custody since 31.12.2014 in connection with Balrampur P.S. Case No.218 of 2014 registered for the offences under Sections 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case only because the brother of the informant, namely, Najrul, used to go to her house as she is in the trade of selling of Mahuwa wine in her house itself. It is further submitted that a fortnight prior to the occurrence, Nanka Murmu, Sanjhala Murmu and Bablu Murmu had threatened the informant to control his brother and restrain him from going to the house of this petitioner, but he did not

Patna High Court Cr.Misc. No.11671 of 2015 (3) dt.26-05-2015 2/2 restrain himself. The said Najrul was killed and it was suspected that this petitioner along with three named accused persons were instrumental in the same.

However, considering the vagueness of the allegations and the fact that the petitioner has no criminal antecedents and is languishing in jail since 31.12.2014, let the above named petitioner be released on bail on her furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Katihar, in connection with Balrampur P.S. Case No.218 of 2014.
