JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 21-10-2021 Heard Mr. Ramautar Sharma, learned Senior Counsel, assisted by Mr. Jitendra Kumar Rai for the petitioners, and Mr. Ajay Kumar Jha, learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 341, 342, 323, 353, 332, 504 and 506/34 of the Indian Penal Code and Section 135 of the Electricity Act, registered in connection with Rajoun P.S. Case No. 379 of 2019 (G.R.No.2576/2019).

The allegation against the petitioners is that they have

Patna High Court CR. MISC. No.3399 of 2020(3) dt.21-10-2021 2/2 pilfered the electricity by hooking the connection wire and due to this act of the petitioners, a loss of Rs. 1,30,745/- has been caused to the Electricity Board.

Learned counsel for the petitioners has submitted that petitioners are ready to deposit 50% of the amount in two equal instalments within two months.

Considering the aforesaid submission, the abovenamed petitioners, in the event of their arrest or surrender before court below within four weeks from the date of communication of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st, Banka in connection with Rajoun P.S.Case No.379 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C. with further condition that petitioners shall deposit 50% of the aforesaid amount in two equal instalments within a period of two months.
