The petitioner is seeking anticipatory bail in connection with Hussainganj P.S. Case No. 277/2018 registered under Sections 30(a)/36/41(1) of Bihar Prohibition and Excise Act, pending in the court of learned Additional Sessions Judge - 2nd- cum - Special Judge, Excise, Siwan.

Considering the fact that there is a seizure report showing that about 23 liters of illicit liquor are said to have been recovered from the Bathan of the petitioner, this court does not find it a fit case to grant privilege of anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is refused.

In case, the petitioner surrenders and prays for regular

Patna High Court Cr.Misc. No.4042 of 2019(2) dt.04-02-2019 2/2 bail in the court below within a period of four weeks from today the same shall be considered on its own merit without being prejudiced by the order of this court.
