JUSTICE SUDHIR SINGH ORAL ORDER 23-05-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 406, 420 and 34 of the Indian Penal Code. Allegation against the petitioner is that he along with one Vivekanand sold the land to the informant with an consideration amount of Rs.4,50,000/- but the same was not provided to the informant. When the land was not provided to her, she demanded return of the money. Accused Vivekanand gave a cheque but that was not encashed due to insufficiency of fund. As such, they cheated the informant.

It has been submitted on behalf of the petitioner that he is in custody since 21.2.2016. He has got no criminal antecedent. Chargesheet has been submitted in the case. From perusal of para8 of the case diary it is evident that the cheque in question was issued by the co-accused Vivekanand. The said Vivekanand has been granted anticipatory bail vide Cr. Misc. no. 11991 of 2016. On behalf of the State, it is submitted that petitioner is

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Adampur) P.S.
