The petitioners, who are father-in-law and mother-inlaw, apprehend their arrest in connection with Sitamarhi Mahila P.S. Case No. 20 of 2019 for the offence under Sections 498A, 341, 323, 504/34 of the Indian Penal Code and Sections 3/4 of the D.P. Act.
Allegation against these two petitioners is that they were involved in torture of informant-opposite party no.2. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the marriage took place in 2015. He further submits that the
Patna High Court CR. MISC. No.7206 of 2020(2) dt.29-02-2020 2/2 husband of the opposite party no.2 has already been granted anticipatory bail by a coordinate Bench of this Court and in fact the informant is living separately from her husband and she has filed Divorce case.
Considering the fact that the petitioners are the fatherin-law and mother-in-law and the husband has already been granted anticipatory bail, the petitioners named above, in the event of arrest or surrender before the court below within one month from today, are directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Sitamarhi (Sadar) in connection with Sitamarhi Mahila P.S. Case No. 20 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
