Petitioner seeks bail in a case registered under sections 363, 366(A) and 376 of the Indian Penal Code. The allegation against the petitioner is that he was neighbour of the informant of this case and he used to have had eyes on the sister of the informant Rinki Kumar aged about 14 years. There is further allegation that he used to throw stone pieces on Rinki Kumari. On the fateful day the victim was in her house alone. The petitioner came in the house put cloth on the mouth of the victim took away forcible in a house and committed rape there.

On behalf of the petitioner it is submitted that

Patna High Court Cr.Misc. No.27464 of 2015 (2) dt.31-07-2015 2/2 petitioner is in custody since 10.06.2013 And charge sheet has been submitted in the case. The case has been committed to the court of session but charges have not yet been framed. Petitioner has no criminal antecedent. It is further submitted that petitioner has remained in custody for more than two years and trial has not yet been concluded.

On behalf of the State it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Additional Sessions Judge-VIII, Patna in S.Tr. No. 219 of 2014 arising out of Masaurhi P.S. Case no. 193 of 2013.
