JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 3 of Explosive Substances Act, Section 17 of C.L.A. Act, and Sections 10, 11, 13 (1) (A)/13(1)(B), 16, 17, 18, 20 of U.A.P. Act.

Although, petitioner is named in the first information report but neither he was caught on the spot nor anything was recovered from his conscious possession. Moreover, co-accused, Lakhan Yadav, from whose house the explosive substance and other articles were recovered, has already been granted privilege of bail by a co-ordinate Bench of this court and similarly, some

Patna High Court Cr.Misc. No.18901 of 2016 (2) dt.04-05-2016 2/2 co-accused have also been granted privilege of bail by different Benches of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sherghati, Gaya in connection with Kothi P.S. Case No. 41 of 2011.
