JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-301, 201/34 of the Indian Penal Code. None has seen actual killing of the deceased persons. In course of investigation, one co-accused, Chunnu Ram was arrested and confessed his guilt, disclosing the involvement of the petitioner and others in the alleged crime. Furthermore, some witnesses claimed to have seen the petitioner and other accused loitering near the place of occurrence in suspicious condition. Learned counsel for the petitioner points out that having similar allegation, one co-accused namely, Jagdish Bhar @

Patna High Court Cr.Misc. No.18672 of 2016 (3) dt.05-05-2016 2/2 Lambu has already been granted privilege of bail. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ramnagar P.S. Case No. 165 of 2013 to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bagaha, West Champaran, Bettiah.
