JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-07-2022 Though the present writ petition has been filed for quashing the notice dated 04.01.2020 issued by the Circle Officer, Bodh Gaya in Encroachment Case No. 21 of 2018-19 but the prayer in the present case has been restricted to grant of an opportunity to the petitioners to file reply to the said notice dated 04.01.2020 and issuance of directions to the Circle Officer, Bodh Gaya to pass final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, after hearing all the affected parties.

Patna High Court CWJC No.2156 of 2020(2) dt.08-07-2022 2/2 Considering the limited grievance of the petitioner, the present writ petition stands disposed off with liberty to the petitioner to file his reply to the show cause notice dated 04.01.2020 within a period of four weeks from today, which shall be considered by the Circle Officer, Bodh Gaya and thereafter final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956 shall be passed within a period of eight weeks thereafter, after hearing the affected parties. It is needless to state that for a period of 12 weeks from today, status quo existing as on today shall be maintained. (Mohit Kumar Shah, J) S.Sb/- U
