JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2022 In pursuance to the earlier order of this Court dated 06.12.2022, the respondents have filed a counter affidavit, wherein the final order passed under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, by the Circle Officer, Lauriya, West Champaran dated 17.12.2021, in connection with Encroachment case no. 12 of 2018-19, has been brought on record.

In such view of the matter, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the said order dated 17.12.2021, by filing appropriate appeal. Liberty so sought, is granted.

Patna High Court CWJC No.1393 of 2022(4) dt.21-12-2022 2/2 It is needless to state that in case, appropriate appeal is filed within a period of two weeks from today, the appellate authority shall consider the same, in accordance with law and pass appropriate orders, thereon and till then, status quo existing as on today qua the land/ house of the petitioner in question, shall be maintained.

The writ petition stands disposed off on the aforesaid terms.
