JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 392/34 of the Indian Penal Code.
The present case was lodged against three unknown persons but in course of investigation, the name of petitioner surfaced in confessional statement of co-accused. Petitioner carries criminal antecedent of five cases but submission on behalf of the petitioner is that brother of the petitioner filed criminal case against the local Dy.S.P. in the year 2013 and after that police remanded the petitioner in several cases which had been lodged against unknown.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.15962 of 2016 (2) dt.21-04-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur in connection with Sahpur P.S. Case No. 177 of 2015.
