JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 385, 386 of the Indian Penal Code.

Petitioner is not named in the first information report but it appears that in course of investigation, petitioner was arrested and the SIM, through which the extortion call was made, was recovered from possession of the petitioner and he confessed his guilt. Petitioner is in jail custody since 10.11.2015 and the investigation against him has already been completed. Moreover, prior to institution of the present case, only one case i.e. Khaira P.S. Case No. 244 of 2015 had been registered against the petitioner.

Patna High Court Cr.Misc. No.15965 of 2016 (2) dt.21-04-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 300 of 2015.
