23-01-2020 Heard learned counsel for the parties.

The petitioner seeks bail in Kotwali P.S. Case No. 119 of 2013 registered for the offence under Sections 406, 409, 419, 420 and 120(B) of the Indian Penal Code. The prosecution case is that a non-banking organization namely Prayag Bank was being run, in which, petitioner was an employee and the said bank, after maturity of the collected amount, did not pay the matured amount to the investors.

Learned counsel for the petitioner submits that petitioner was simply a Class-III employee of the bank and there is no complaint against him that he had collected money from any local people. He further submits that other similarly situated

Patna High Court CR. MISC. No.3962 of 2020(2) dt.23-01-2020 2/2 accused persons have already been granted bail by this Hon'ble Court, vide Annexure 2 'series'. Petitioner claims no criminal antecedent and he is in custody since 26-11-2019. In view of aforesaid facts and circumstances as well as nature of accusation, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Munger in connection with Kotwali P.S. Case No. 119 of 2013 on the following conditions:

"(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
