JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 201/34 of the Indian Penal Code and Sections-3/4 of Dowry Prohibition Act.
Petitioner happens to be husband of the deceased and it appears that the marriage of the petitioner had taken place with the deceased in the year, 2009 and after marriage, the deceased gave birth to a child out of the aforesaid wedlock but the informant claims that the deceased was subjected to cruelty due to non-fulfillment of illegal demand of motorcycle and cash and subsequently, she along with her son was killed by the petitioner and other accused.
Patna High Court Cr.Misc. No.16887 of 2016 (2) dt.28-04-2016 2/2 Submission on behalf of petitioner is that the deceased met with an accident while crossing the railway track as a result whereof, she along with her son died on the spot and after cremation of the dead body of the deceased as well as her son, the informant lodged this case with ulterior motive. The petitioner is languishing in jail custody since 2710-2015 and the investigation against him, appears to have already been completed.
Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Rafiganj P.S. Case No. 01 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Aurangabad. . (Hemant Kumar Srivastava, J) A.K.V./- U T
