The petitioner is accused in connection with Kateya P.S. Case No. 258 of 2014, registered under Section 304(B), 201/34 of the Indian Penal Code.

The accusation is of killing of daughter of the informant by her husband and other in-laws due to nonfulfillment of demand of motorcycle and cash of Rs. 50,000/-. Learned counsel for the petitioner submits that the petitioner is the father-in-law of the deceased. Further submission is that, in fact, the deceased died due to chest pain on 05.11.2014 and the family members of the informant participated in the funeral ceremony of the deceased, but due to ulterior motive the informant lodged the present case on

Patna High Court Cr.Misc. No.17726 of 2016 (2) dt.29-04-2016 2/2 07.11.2014. Further submission is that husband of the deceased Ashish Sarkar @ Sonu is in custody in the present case. The petitioner having no criminal antecedent is in custody since 30.11.2015. Further submission is that similarly situated coaccused Monu Devi @ Ramala Devi and Manoj Sarkar have already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 07.04.2016 passed in Criminal Misc. No. 13326 of 2016 and order dated 23.09.2015 passed in Criminal Misc. No. 44356 of 2015, respectively. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S.
