The petitioner has preferred this application for grant of regular bail in a case registered under sections 308, 341, 342, 323, 325, 379 and 34 of the Indian Penal Code. As per the prosecution case, the accused persons including the petitioner herein are stated to have assaulted the informant. Further allegation against the petitioner is of having assaulted with the butt of the pistol on the neck of the informant. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case which would also be evident from the injury report quoted in the order of the learned court below from perusal of which it would transpire that there is no injury on the neck. The petitioner is in custody since 23.10.2019 and chargesheet has been submitted in

Patna High Court CR. MISC. No.15151 of 2021(4) dt.18-11-2021 2/2 the case.

The application for bail is opposed by learned APP for the State who submits that the petitioner has antecedents of three cases from before.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with contents of the injury report, the petitioner is directed to be enlarged on bail in connection with Mahua P.S. Case no. 542 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
