The petitioners seek bail in a case under Section 302 and other sections of the Indian Penal Code.

The informant, Md. Ubaid Ahmad named altogether 18 persons and alleged that they all surrounded his brother, Md. Sohail and assaulted him with iron rod and knife. Md. Mojibul Rahman assaulted his brother with knife and Md. Shamim assaulted with iron rod. They also assaulted his niece Kahkashan Khatoon and Darkashan Khatoon.

It is submitted that specific allegation is made against Md. Mojibul Rahman and Md. Shamim. It is submitted that another Md. Shamim, son of late Md. Ali Hasan was injured and

Patna High Court Cr.Misc. No.25460 of 2015 (2) dt.22-07-2015 2/2 he is alleged to have assaulted the deceased with iron rod and he has already been enlarged on bail vide order passed in Cr. Misc. No.14265 of 2014. No specific allegation is made against the petitioners. Other accused persons, namely, Rukhsana Khatoon, Mumtaz Khatoon, Sakila Khatoon & anr., Md. Abdul Jabbar, Md. Firoz and Md. Ashique have already been enlarged on bail. Considering the facts aforesaid and the nature of allegation made against the petitioners, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Pupri at Sitamarhi in Bajpatti P.S. Case No. 213/2013.
